Official Rules
NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
- ELIGIBILITY
The Contest is open and offered only in Great Britain, France, Germany, The Netherlands and Belgium to legal residents of Great Britain, France, Germany, The Netherlands and Belgium at least 18 years of age, or the age of majority in their jurisdiction of residence, whichever is older, all at time of entry, who are current users of Dragon. Employees, officers and directors of Nuance, ("Sponsor"), and each of its affiliates, subsidiaries, distributors, advertising, public relations, and promotion agencies and members of the immediate family and persons living in the same household of any said employee, officer or director are ineligible. By participating, entrants agree to these Official Rules and the decisions of the Sponsor which are final and binding in all respects. Void where prohibited.
- PROMOTION PERIOD
Entries must be submitted between April 24, 2008 at 12:00:01 A.M. Central European Time ("CET") and June 30, 2008 at 11:59:59 P.M. The Promotion computer is the official time keeping device for the Promotion.
- TO ENTER, CREATE, AND SUBMIT
- Web Site Access/Registration
A call for stories and videos is made through a pipeline message to the Dragon user database, through the Nuance website and through a press release. To participate in the Contest, you must register and leave your entry on our website. The best entry in each of the categories (see below) will win a prize. There will be a 1st, a 2nd and a 3rd place. There will be another prize for the best video and best review.
- Parameters/Contents
You must create a story or video in the English or in your own language, in which you provide a testimonial, a story and/or an endorsement of Dragon.
When your story or video is complete, before submitting your entry, you must click in the box provided confirming that you have read and agree to these Official Rules. Once a story or video is submitted it cannot be changed, altered or modified, becomes the sole property of Sponsor and will not be returned. Any Entry, which in the sole opinion of Sponsor is deemed to be inappropriate for publication will be disqualified. Entries (i) must be the original and sole creation of the submitting entrant, and all right, title and interest including but not limited to the copyright in any Entry, must be owned solely by the submitting entrant, (ii) may not have been submitted in any other competition, (iii) may not have been published, (iv) may not infringe upon any third party's rights or contain material that is or may be considered defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light.
Entries cannot contain, among other things, the trademark, tradename or logo of any third party or entity or product, cannot name, depict or describe any person (living, dead, or fictional) other than the Entrant or persons who may appear incidentally and cannot be identified.
By entering, each Entrant grants permission for the use of his/her Entry, and his/her name and business name, to be posted on the Internet and Web site or any web site in connection with this Contest, and the advertising, promotion, and publicity of the Contest.
- Rights In Entries
(i) Where permitted by law, each entry of a story and particularly the winning entrant, irrevocably transfers to Sponsor, all of his/her right, title and interest in and to his/her Entry, including but not limited to all copyright rights, and waives any rights of droit moral (and any similar rights wherever in the world arising) in favor or Sponsor.
Upon request of Sponsor, each entrant shall execute and deliver such additional instrument of assignment and waiver of droit moral and of any similar rights wherever in the world arising.
(ii) Should the above rule not be permitted by law for any reason whatsoever, each entrant hereby grants, where permitted by law, to Sponsor an exclusive, perpetual, worldwide, royalty free irrevocable license to use his/her Story at any time or times in all media worldwide, including on the Internet/ World Wide Web, for advertising, commercial, trade and promotional purposes, without additional compensation unless prohibited by law, and without notice, review or approval.
- Additional Conditions
Each participant warrants that participant’s employer’s policy permits participating and accepting prizes in trade promotions
- JUDGING/VIEWING/WINNING
(A) Eligible stories will be judged by a judging panel [composition of jury to be specified] selected by Sponsor (including at least one other independent judge) and the judges' decisions are final and binding on all judging matters.
The 4 categories of stories are (1) creativity, (2) productivity, (3) "I speak Dragon to improve my life" and (4) "I speak Dragon to the world". In each of the categories, the judges will select the best endorsement of Dragon [criteria of selection to be specified]. The judges will also select the best video and best review.
(B) Eligible stories will be posted on the Web site from April 24, 2008 to June 30, 2008. Persons registered at the Web site will be able to view the stories until the end of 2008. Winners will be notified by Sponsor through the website and press releases during June 2008 and prizes will be sent to the winners during the summer of 2008.
- PRIZE
The best story wins a Medion Nav device with Nuance Speech Recognition (approximate retail value: 319 EUR).
Second place wins a Visioneer Strobe Scanner with Nuance PaperPort and OmniPage (approximate retail value: 149,99 UK£ or 199 EUR in other countries).
Third place wins the Nuance Productivity Suite (approximate retail value: 299 EUR).
The best video and the best review win a Nintendo Wii (approximate retail value: 250 EUR)
If the prize winner cannot accept the prize as stated, the prize will be forfeited in its entirety and awarded to an alternate winner. Expenses not stated are the sole responsibility of the prize winner. Prize cannot be transferred or redeemed for cash, but Sponsor reserves the right to substitute a prize of comparable or greater value should the prize become unavailable for any reason. All taxes, duties and the like are the sole responsibility of the winner.
- GENERAL
Nothing in these Official Rules limits or excludes the Sponsor’s liability for fraud or for death or injury caused by its negligence or for any other liability that cannot lawfully be limited or excluded. Subject to the foregoing, by entering, entrants release and agree to indemnify and hold harmless Sponsor and all of the respective employees, representatives and agents from and against all liability, claims, losses, including, by way of example only, liability, claims and losses arising from violation of intellectual property rights or personal rights, due in whole or in part, directly or indirectly to the acceptance, possession, misuse or use of the prize, or participation in this Promotion, or participation in any Promotion-related activity. Sponsor confirms that he acts, to the best of his knowledge, in accordance with the applicable advertising practice codes and other rules in each of the mentioned countries, i.a. the Dutch Advertising code and the Dutch Code of Conduct for promotional games of chance.
- LIMITATIONS OF LIABILITY
Sponsor is not responsible for lost, late, stolen, illegible, misdirected, postage due, separated or non-delivered mail, entries or e-mails.
Sponsor assumes no responsibility for any error, defect or delay in operation or transmission of emails or the Web site. If, for any reason, Promotion is not capable of running as planned, Sponsor reserves the right, to cancel or terminate Promotion. In such event, Sponsor reserves the right to determine the winner from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor.
EXCEPT AS OTHERWISE SET OUT ABOVE AND ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SPONSOR BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, ARISING OUT OF EFFORTS TO CREATE OR SUBMIT THE STORY OR VIDEO.
- DISPUTE RESOLUTION/CHOICE OF LAW
Except where prohibited, participants agree that: (a) any disputes connected with this Promotion shall be resolved exclusively by an action in the courts in Belgium and (b) any claims shall be limited to actual costs incurred, but in no event attorneys' fees or disbursements. All issues and questions shall be governed by Belgian laws.
- LANGUAGES
In the event that these Rules, or any promotion, or other material, are presented in a language other than English and there is a discrepancy between the languages of these Official Rules, except where prohibited, the English version shall prevail. In the event there is a discrepancy in any materials and the Official Rules, these Official Rules shall prevail.
- If any clause, condition or part of a clause is invalid under one or several national laws of Great Britain, France, Germany, The Netherlands and Belgium, the rest of the clause or condition and the remaining part of the Official Rules will remain intact. The invalid clause or part of clause will in that case be replaced by Sponsor by a valid clause or part of clause that comes as close as possible to the original invalidated clause.
- PRIVACY
Personal Information is subject to Sponsor’s Privacy Policy available at http://www.nuance.com/company/privacy. To participate in this Promotion, if you are not already registered with the Sponsor, you will be asked to provide personal information, such as your name, title, company, mailing or billing or shipping address, work e-mail address, work phone number and other personal identifying information.
By agreeing, Nuance has your permission to use your submitted entry for marketing purposes. Nuance will only reference your last name, the country that you’re based in and a snap shot of how Dragon has impacted your life. No private contact details will be disclosed when referencing your entry. Please be aware that your prizes are not conditional on you agreeing to be referenced for marketing purposes.
When you submit personal information to Nuance, you understand and agree that Nuance may transfer, store, and process your customer profile in any of the countries in which Nuance and its affiliates maintain offices, including countries outside the European Economic Area (“EEA”) which may offer less legal protection to personal data than the laws of jurisdictions within the EEA. For the purposes of contests, information is collected to qualify the entry and contact you regarding the contest or prize awards. Nuance also uses information that you provide as part of its effort to send you (if you accepted by opting-in as asked above) information about product upgrades, special offers, and other Nuance products and services. If you do not want the information you provide to Nuance to be used to inform you of other products and special offers, or if you wish to change or modify information previously provided, if you want Nuance to delete all information on your profile, or if you want to have access to your profile, you can do so by following the procedures set forth in the …section of the Privacy Policy. Nuance may share your information with a distributor or partner in your area who can assist with your request for information if Nuance does not have its own sales force your area. The distributor or partner may use these details to contact you about the support services that they may offer as well as other Nuance products or services that you may be interested in. Complaints about the promotion should first be made per email to the Sponsor. Sponsor will pass the complaints on to the jury and will communicate the decision of the jury within a week following the complaint. The complaints procedure does not hinder the filing of a claim as per article 8.
